State Duma prohibits Commissioner for Human Rights in Russia from having foreign citizenship

The State Duma has adopted in the first reading the draft law prohibiting the Commissioner for Human Rights in the Russian Federation from having foreign citizenship.

The deputies made amendments according to which the Russian Ombudsman can not have foreign citizenship or a residence permit or any other document confirming the right to live permanently in a foreign country.

In addition, this draft law establishes the status of the Commissioner for Human Rights in the entities of the Russian Federation. According to these amendments, in order to ensure the effective work of the regional ombudsmen there`s a permission to provide them with organizational, legal and informational support within the scope of competence and to create The Human Rights Council as an advisory and consultative body with one representative from each federal district.

WHO IS FORBIDDEN TO HAVE DUAL CITIZENSHIP

In 2006 the Russian law was amended to prohibit people holding state and municipal offices from dual citizenship. The Secretary and members of the Security Council, the President of Russia, the State Duma deputies, members of the Federation Council can not have dual citizenship. Later amendments were adopted banning it for the Prime Minister and the Deputy Prime Minister of the Russian Federation.

Draft law banning dual citizenship for high-ranking civil servants

In March 2014 the deputy from the "Spravedlivaya Rossiya" party Alexey Kazakov submitted a draft law on prohibiting high-ranking civil servants and members of their family from having foreign citizenship or residence permit in another state to the State Duma.

According to the explanatory note to the draft law, it is people who "are in duty bounden to make decisions concerning the issues of sovereignty and national security of the Russian Federation", as well as their spouses and minor children. This law should extend to people holding a public office, the post of the First Deputy and the Deputies of Attorney General, members of the Board of Directors of the Central Bank, public positions in the entities of the Russian Federation, the Federal Public Service positions, government corporations (companies) positions. According to the draft law they won`t be allowed "to have foreign citizenship or a residence permit or any other document confirming the right to live permanently in a foreign country”.
